Please carefully review the following rules that govern our Credit Report Policy. This Credit Report Policy, along with the other Point Policies described below, govern how we use certain information that you provide to us via point.com (and any subdomains thereof) (the “Site”), which is owned, operated, licensed, and controlled by Point Digital Finance, Inc., a Delaware corporation (together with its related, affiliated or subsidiary companies, “Point”, “we”, or “us”).

By using this Site and requesting an offer from Point or applying for a Point product, you will be initiating a credit inquiry, as described below, and you hereby agree to our Credit Report Policy. In addition to this Credit Report Policy, you are subject to additional policies, such as our Terms and Conditions of Use Agreement (“Terms of Use”), Privacy Policy, Credit Report Policy, and Consent to Electronic Communications and Electronic Signatures (collectively, the “Point Policies”), that may be posted on the Site from time to time. All terms from such Point Policies are hereby incorporated by reference. You also have certain rights under the Fair Credit Reporting Act, a summary of which can be found here.

CHANGES TO CREDIT REPORT POLICY

Point reserves the right at its sole discretion, to change, modify, add or remove portions of this Credit Report Policy and the other Point Policies at any time, without notice. It is your responsibility to check these policies and terms periodically for changes. Your continued use of the Site following the posting of changes will mean that you accept and agree to the changes. As long as you comply with these terms and policies, Point grants you a personal, non-exclusive, non-transferable, limited privilege to enter and use the Site.

CONSUMER REPORTS

We may request consumer reports and related information about you in connection with either your inquiry as to whether you qualify for a Point product (a “Qualification Inquiry”) or your submission of an application for a Point product on the Site (“Product Application”), as further described below. Such requests for consumer reports are regulated by the Fair Credit Reporting Act, which requires that any person using a consumer report must have a permissible purpose. A permissible purpose includes when a consumer (in this case, you) has provided written instruction to the user of the consumer reports (in this case, Point) to obtain such reports. These consumer reports may be requested from one or more U.S. national credit reporting agencies, such as Experian, Equifax and TransUnion (collectively, the “Credit Bureaus”).

QUALIFICATION INQUIRY

During your Qualification Inquiry, we may conduct an eligibility inquiry (known as a “soft credit pull”) through the Credit Bureaus to determine whether you initially qualify for a Point product. This inquiry does not affect your credit score. You certify that your Qualification Inquiry on the Site is a transaction that you initiated with Point. You further understand and acknowledge that by submitting your Qualification Inquiry on the Site during the Qualification Inquiry process, you are providing written instructions to Point under the Fair Credit Reporting Act, which authorizes Point to obtain information from your personal credit profile and/or other information from the Credit Bureaus. Upon your request, we will inform you of the name and address of any Credit Bureau from which we obtained your consumer report.

PRODUCT APPLICATION

In connection with your Product Application, we may conduct a credit inquiry (known as a “hard credit pull” or “hard credit inquiry”) through the Credit Bureaus to authenticate your identity, to make application decisions and for other related purposes. This inquiry will be recorded on your credit history and may impact your credit score. You certify that the submission of your Product Application on the Site is a transaction that you initiated with Point. You further understand and acknowledge by entering and submitting your Social Security number during the Product Application process, you are providing written instructions to Point under the Fair Credit Reporting Act, which authorizes Point to obtain information from your personal credit profile and/or other information from the Credit Bureaus. Upon your request, we will inform you of the name and address of any Credit Bureau from which we obtained your consumer report.

In the event Point determines not to offer a Point product to you based on the consumer report Point received, Point will notify you of that determination in compliance with the Fair Credit Reporting Act.

MONITORING THE POINT PRODUCT

In the event you are approved for and accept a Point product, you hereby authorize Point to obtain consumer reports in the form of soft credit pulls at various times during the term of your Point product in connection with the servicing and monitoring of such product.

CONSUMER REPORTS FOR YOUR OWN USE

Pursuant to the Fair Credit Reporting Act and the Fair and Accurate Credit Transactions Act, you are allowed to receive a free credit report from each of the three U.S. national credit reporting agencies (Experian, Equifax, and TransUnion) during any twelve-month period. You may also be able to receive free credit reports as permitted by state law; contact your state or local consumer protection agency or state attorney general to learn more about your rights under state law.
